Which Case Outcomes Qualify for Expunction in Texas

Chapter 55A of the Texas Code of Criminal Procedure governs who can obtain an expunction. Eligibility turns on how your case concluded, not simply how long ago it happened.

Dispositions that commonly qualify:

  • A dismissal of the charge
  • An acquittal at trial
  • A grand jury no-bill
  • An arrest where formal charges were never filed and the applicable statute of limitations has expired

Dispositions that generally do not qualify:

  • A conviction, including cases where the defendant completed straight probation
  • Completed deferred adjudication, even when the underlying case was ultimately dismissed

Deferred adjudication isn’t a dead end. Those cases may qualify for an order of nondisclosure, which seals the record from public view without destroying it. Eligibility for either remedy depends on the specific facts of your case, and I review those facts carefully before advising you on the right path.

Filing an Expunction Petition in Rockwall County
