In the state of Texas, the divorce process begins when one spouse files a petition for divorce in one of the district courts where the couple lives. If children are involved, the next step that would need to occur is a court hearing that can provide you with temporary orders for custody of the children. This hearing is almost a "mini-divorce" case within a divorce because these orders will set parameters for primary custody, who gets the marital home, and who will pay which bills until the divorce is finalized.
Visitation for children may also be temporarily addressed in these court orders as well.
After the temporary orders have been entered, the divorcing parties might engage in discovery. In the discovery phase, depositions, request for documents and other forms to support the case may be required of you by your attorney and your spouse's lawyer. Most courts will also require that the divorcing parties attend at least one mediation session before the case can be set for trial. If the case does not get settled in mediation, the case is generally given a trial date before a court. At the trial, the judge will decide the major issues of divorce including permanent custody, visitation,
child support arrangements, spousal support,
property division and any other issues that may be relevant to the case.
